1. Agreement to these Terms

These Terms of Service (“Terms”) govern your access to and use of NEMEQ (“NEMEQ,” “we,” “us,” or “our”), including our website, study platform, and The Thinker. By creating an account or using NEMEQ, you agree to these Terms. If you do not agree, do not use the service.

2. Eligibility and accounts

• You must be legally able to enter into these Terms in your place of residence, or use NEMEQ with the involvement and permission of a parent or guardian where required.
• You are responsible for providing accurate account information and keeping your sign-in credentials and devices secure.
• You are responsible for activity that occurs through your account. Tell us promptly if you believe your account has been accessed without permission.

3. The service

NEMEQ is a study and practice tool. It can organize study materials, record study activity, provide AI-assisted explanations, and generate practice or progress insights. Features may change, be limited, or become unavailable as we improve the service.

NEMEQ does not guarantee a particular grade, exam result, certification, admission decision, or amount of academic progress. Readiness estimates and recommendations are informational and depend on the quality and amount of available evidence.

The Thinker does not use chat details as long-term teaching memory. It personalizes responses using the current request and relevant NEMEQ studying data, while academic claims remain grounded in qualifying evidence.

4. Your content

You retain ownership of the documents, images, questions, answers, notes, and other content you submit (“User Content”). You give NEMEQ the limited permission needed to host, store, reproduce, process, display, and transmit User Content to provide, secure, and improve the features you request.

You represent that you have the rights and permissions needed to submit User Content and that doing so does not violate another person’s rights, your school’s rules, or any applicable law. Review uploads before sending them, and do not upload passwords, financial information, health information, confidential records, or restricted exam content unless you are authorized to do so.

5. Academic integrity and acceptable use

NEMEQ is for studying and authorized educational use. We do not condone cheating. Do not use NEMEQ to get answers during a live exam or assessment, evade proctoring, impersonate another student, submit AI-generated work where it is not allowed, or break any school, instructor, employer, exam, or testing-provider rule.

You may not:

• Upload content that is unlawful, abusive, infringing, discriminatory, threatening, or invasive of another person’s privacy.
• Probe, scan, reverse engineer, copy, resell, or interfere with NEMEQ or its security measures.
• Attempt to access another person’s account, data, study materials, or private files.
• Use automated means to access the service in a way that burdens or disrupts it, or use NEMEQ to build a competing service without permission.

6. AI output and educational responsibility

The Thinker uses AI and may produce inaccurate, outdated, incomplete, or unsuitable responses. Treat its responses as study assistance, not guaranteed answers. You are responsible for checking important information against your course materials, instructor guidance, official sources, and applicable assessment rules.

Do not rely on NEMEQ for medical, legal, financial, mental-health, emergency, or other professional advice. NEMEQ is not an instructor, examiner, proctor, or substitute for qualified professional guidance.

7. Intellectual property

NEMEQ and its software, design, branding, text, graphics, and original features are owned by or licensed to NEMEQ and are protected by applicable intellectual-property laws. These Terms give you permission to use NEMEQ for its intended purpose; they do not transfer ownership to you.

8. Suspension and termination

We may suspend or terminate access if you violate these Terms, create risk for other users or NEMEQ, use the service unlawfully, or if we discontinue a material part of the service. You may stop using NEMEQ at any time. Provisions that should reasonably survive termination, including ownership, disclaimers, limitations of liability, and dispute terms, will continue to apply.

9. Disclaimers

To the extent permitted by law, NEMEQ is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant that the service will always be accurate, uninterrupted, secure, error-free, or available; that content will be preserved; or that the service will meet a particular academic or personal objective.

10. Limitation of liability

To the extent permitted by law, NEMEQ and its operators, providers, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, grades, opportunities, profits, or goodwill arising from or related to your use of the service. Nothing in these Terms limits liability that cannot legally be limited.

11. Changes to these Terms

We may update these Terms as the service changes. When we make a material change, we will update the date at the top and provide notice through the service or another appropriate channel. Continued use after the updated Terms take effect means you accept them.

These Terms do not currently designate a registered office, governing-law jurisdiction, or alternate dispute-resolution process; any dispute will be handled through the legal procedures that otherwise apply to the parties.
